1. ACCEPTING THESE TERMS
SportsTek offers an online platform that allows third parties who offer facility rentals, programs, trainings, or other services (third parties that offer such services are “Providers” and the services they offer are “Provider Services”) to publish such Provider Services on the Site (each such publication, a “Listing”) and to communicate and transact directly with registered users (“Users”) that are seeking to book such Provider Services. Our Providers, advertisers, social media partners, service providers and certain other parties are collectively referred to as our "Business Partners" in this document.
2. What personal information do we collect from the people that visit our Site?
Individual Users: If you desire to access or use the Site, you will be required to create an account and submit certain Personal Information and other information to SportsTek including your name, email address, password, telephone number, the city and state where you are located, and the types of Provider Services in which you are interested.
When you purchase a Provider Service on the Site, the Provider may require you to provide additional information about yourself and/or the person who will utilize the Provider Service (“Service User”). This information may include but is not limited to your relationship to the Service User, the Service User’s name, city and state, gender, age, height, weight, and skill level in regard to the Provider Services being purchased. In order to furnish you with the Provider Services in a safe manner, the Provider may require information regarding the health of the Service User including but not limited to information about any allergies or disabilities. You may also be required to execute a liability waiver in order to use the Provider Services. Although SportsTek facilitates the collection of Personal Information and other information for its Providers, it does not determine what information the Providers will require and is not responsible for the policies (including privacy policies) of its Providers.
If you are purchasing a Provider Service for an organization, such as a league, you will be required to provide information regarding the organization including its name, address, and liability insurance information, which may include the uploading of insurance documentation. You may also be required to execute a facility rental agreement. We will also collect a contact name, phone number, and email address for the organization. To the extent that this information pertains specifically to the person providing the information, it is Personal Information, and by providing such Personal Information, you are consenting to our collection, use and sharing of such information as stated herein.
When you purchase a Provider Service, we will direct you to Stripe, our third-party payment processor to provide a credit card number and other personal data needed to complete the transaction. Stripe is certified to meet the industry standards for security and confidentiality, as well as applicable laws.
Providers: If you are using the Site on behalf of a Provider, we will collect the Provider’s name and address, and, if applicable, rental agreement. We will also collect a contact name, phone number, and email address for the Provider. To the extent that this information pertains specifically to the person providing the information, it is Personal Information, and by providing such Personal Information, you are consenting to our collection, use and sharing of such information as stated herein.
3. Sensitive Personal Data
Except as required in order for Providers to furnish Provider Services that you purchase, we ask that you not send us, and you not disclose, any sensitive personal data (for example, social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through the Site or otherwise to us.
Use Data: By choosing to use the Site, you agree to provide SportsTek with certain information that is automatically created, collected, and recorded by your use of the Site (“Use Data”). SportsTek uses third-party website browser software tools (the “Tools”), such as “cookies,” web server logs, and analysis software (including Google Analytics) to gather Use Data.
Use Data may include your age range, whether you are a new or return user, your computer or mobile device operating system name and version, and manufacturer and model, browser and email client type, internet browsing and usage habits, your internet service provider, certain device settings, approximate geographical location information, and current IP address. It may also include business and technical statistics, such as the number of new visitors to the Site, the date and time of visits, the pages viewed and paths followed by users to and through the Site, and how long users remain on the Site.
4. How do we use your information?
SportsTek uses your information, including Personal Information, for various purposes in connection with its business, including, but not limited to, providing and managing services in connection with the Site, providing customer service and support, responding to your inquiries and requests, providing you with information related to the Site or that we otherwise believe will be of interest to you, providing targeted advertising messages we believe will be of interest to you, including in our emails and other communications, and notifying you about certain changes to the Site.
SportsTek uses Use Data in order to monitor use of the Site and our services, for the Site’s technical administration, and to improve the Site and our services. We also utilize Use Data for marketing purposes, to conduct tracking and analytics, and to help us understand how people use the Site.
We will send you an email when you create a profile on the Site and will also send you emails regarding transactions you have entered into on the Site. We may also send you emails that we think may be of interest to you such as special deals, new Provider Services, or to remind you about Provider Services in your shopping cart. Each email we send contains an easy, automated way for you to unsubscribe from further emails from us. Select the "unsubscribe" link in the footer of an email from us and follow the directions to communicate your preferences to us.
6. EMAIL ADVERTISEMENTS
We may also use your email to send you email advertisements. The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to stop emails from being sent to them, and spells out penalties for violations. In accordance with the CAN-SPAM Act, we agree to do the following:
• NOT use false or misleading subjects or email addresses
• Identify the message as an advertisement in some reasonable way
• Include the physical postal address of our business or site headquarters
• Monitor third party email marketing services for compliance, if one is used
• Honor opt-out/unsubscribe requests quickly
• Allow users to unsubscribe from receiving future emails from SportsTek by using the instructions and link at the bottom of each email
7. Sharing Data
We share Personal Information with our Providers, including name, email, and other required Personal Information, which may include sensitive personal information, and other information in order for them to furnish you with the Provider Services that you purchase. This information will only be shared with those Providers from whom you purchase Provider Services and will not be shared with our other Providers. SportsTek is not responsible for the practices and policies (including privacy policies) of our Service Providers, therefore, you should review the privacy practices and policies of the Service Providers.
We may also share information collected from you, including Personal Information, with our other Business Partners. For example, based on your user profile, we may provide your information, including your name, email and general location data to certain advertisers. Those advertisers may contact you. We also share de-identified information and/or aggregated information with our Business Partners.
Service Providers: We engage certain trusted third parties to perform functions and provide services to us, including, without limitation, hosting and maintenance, customer relations, database storage and management, data analysis, payment processing, and legal, accounting, and/or marketing services. We may share your Personal Information, other information, and/or Use Data with these third parties, but only to the extent necessary to perform these functions and provide such services, and only pursuant to binding contractual obligations requiring third parties to maintain the privacy and security of your data.
Non-personally identifiable information may be provided to other parties for marketing, advertising, or other uses.

SportsTek uses reasonable care to protect the privacy and security of Personal Information and to ensure that our systems are secure and meet industry standards. Where appropriate, we employ firewalls, encryption technology, and user authentication systems (e.g., usernames and passwords) to control access to systems and data. Unfortunately, no Internet transmission is ever completely secure, and we cannot guarantee that unauthorized access, hacking, data loss or other breaches will never occur.
